Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FillAI browser extension, website, and related services (collectively, the "Service") provided by FillAI ("we," "our," or "us"). By installing, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not install or use FillAI.

1. Eligibility

You must be at least 16 years old to use the Service. By using FillAI, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

FillAI is a browser extension that assists users in filling job application forms by:

• Storing user-provided professional profile information locally (encrypted on your device)
• Detecting form fields on web pages
• Auto-filling form fields with matching profile data
• Using AI (Google Gemini) to generate contextual responses for complex form fields (e.g., cover letters, essay questions)
• Parsing uploaded resumes to extract profile information

3. Account Registration

• You must sign in with a valid Google account to use the Service.
• You are responsible for maintaining the security of your Google account and browser.
• You must provide accurate and complete information in your profile.
• You may not create multiple accounts to abuse free credits or circumvent restrictions.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Payments

4.1 Credit System

• New accounts receive 100 free credits upon registration.
• AI-powered form fills consume 5 credits per generation.
• Heuristic (non-AI) fills are free and do not consume credits.
• Credits are non-transferable between accounts.

4.2 Purchases

• Additional credits can be purchased through our payment processor (Dodo Payments).
• All prices are displayed at checkout and are inclusive of applicable taxes unless otherwise stated.
• Payments are processed securely by our third-party payment provider. We do not store your payment card details.

4.3 Subscriptions

• Subscription plans auto-renew unless cancelled before the renewal date.
• You may cancel your subscription at any time through the billing portal.
• Cancellation takes effect at the end of the current billing period.
• Credits granted through subscriptions are allocated at each billing cycle and do not roll over unless explicitly stated.

4.4 Refunds

5. Acceptable Use

You agree NOT to use FillAI to:

• Submit false, misleading, or fraudulent information on job applications
• Impersonate another person or misrepresent your qualifications
• Violate any applicable law, regulation, or third-party terms of service
• Spam, automate mass applications, or engage in abusive application behavior
• Attempt to reverse-engineer, decompile, or extract source code from the extension or backend
• Exploit vulnerabilities, bypass rate limits, or abuse the credit system
• Use the Service for any purpose other than legitimate job application assistance
• Interfere with or disrupt the Service or servers connected to the Service
• Share, resell, or redistribute your account access or credits
• Use automated tools, bots, or scripts to interact with the Service (beyond normal extension operation)

6. AI-Generated Content

6.1 Nature of AI Output

FillAI uses artificial intelligence (Google Gemini) to generate text for form fields. You acknowledge and agree that:

• AI-generated content is produced algorithmically and may not always be accurate, complete, or appropriate
• You are solely responsible for reviewing and verifying all AI-generated content before submitting it on any form or application
• AI outputs do not constitute professional advice (legal, career, or otherwise)
• We do not guarantee that AI-generated content will result in favorable outcomes for your applications

6.2 Your Responsibility

You are solely responsible for all content submitted through forms using FillAI, whether auto-filled from your profile or generated by AI. You must review all filled content before submission and ensure it is truthful, accurate, and appropriate for the context.

6.3 No Guarantee of Results

FillAI is a productivity tool. We make no representations or warranties that using the Service will result in job interviews, offers, or any particular outcome. The success of job applications depends on numerous factors beyond our control.

7. Intellectual Property

• The FillAI extension, backend, website, branding, and all associated code are owned by us and protected by intellectual property laws.
• You retain ownership of the personal data and profile content you provide.
• AI-generated outputs created for you through the Service are yours to use for their intended purpose (job applications).
• You grant us a limited, non-exclusive license to process your profile data solely for the purpose of providing the Service.

8. Disclaimers and Limitation of Liability

8.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

8.2 No Warranty on Availability

We do not warrant that the Service will be uninterrupted, error-free, secure, or available at all times. We may experience downtime for maintenance, updates, or due to circumstances beyond our control.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FILLAI, ITS OWNERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Damages arising from reliance on AI-generated content
• Damages resulting from unsuccessful job applications
• Damages from unauthorized access to your data due to your own security practices
• Any damages exceeding the total amount you paid to us in the 12 months preceding the claim

8.4 Third-Party Websites

FillAI operates on third-party websites (job boards, company career pages, etc.). We are not responsible for the content, policies, or practices of these third-party sites. Your use of those sites is governed by their respective terms.

9. Indemnification

You agree to indemnify, defend, and hold harmless FillAI and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Content you submit through or using the Service
• Your violation of any third-party rights or applicable laws
• Any false or misleading information submitted through forms using FillAI

10. Termination

• You may stop using the Service at any time by uninstalling the extension and/or requesting account deletion.
• We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms.
• Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited upon termination for cause (violation of Terms). For voluntary termination, see our Refund Policy.
• Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

11. Modifications to the Service and Terms

• We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
• We may update these Terms from time to time. Material changes will be communicated via the extension or website. Continued use after changes constitutes acceptance.
• Changes to pricing or credit costs will not apply retroactively to already-purchased credits.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction in India.

You agree to attempt to resolve any dispute informally by contacting us first. If a dispute is not resolved within 30 days, either party may pursue formal resolution.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and FillAI regarding the use of the Service and supersede all prior agreements and understandings.
